Avoiding Failure-To-Report Revenue/Expenses Surcharge Fee

If you are reading this you may be here because we have Affiliates who failed to file the monthly Gross Revenue and Expense Report for a month and were charged a Failure-To-Report surcharge. Please note the filing deadline for a month's report is the 10th of the month due to the early, biannual SESAC reporting deadline. This date is the 10th of the month deadline and is pointed out in the emails send you asking you to file on time. (See copy of the final warning email below)

Your PRONETLicensing Terms Of Servce (based on our agreements with the PRO's and on copyright law) requires you to file a monthly Expense and Gross Revenue report. The report can be filed between the first and the 15th of the month for the preceeding month. For instructions on filing your report please click here.
See below for a copy of the letter sent on August 28 formally notifying of the change to our Terms Of Service. Numerous similar emails were sent over the last three months notifying our Affiliates of the importance of filing this report and of the upcoming change.

When you fail to report, PRONETLicensing must complete your report for you using our best estimate of your actual monthly expenses and gross revenue. This costs PRONETLicensing signficant clerical expenses. When PRONETLicensing is audited by one of the PRO's, the auditor may not accept our guestimate of your finanical numbers and may charge us additonal penalty fees as well. For these reasons, for the reports (due the 10th to the 15th) PRONETLicensing charges a fee based on the greater of $5 or 20% of your licensed revenue, if we have to complete your report for you. I have sent numerous letters over the last four months warning of this surcharge. See bottom letter below for a copy of the letter sent  formally notifying of the change to our Terms Of Service.

Example:
The October Gross Revenue/Expense report will be due by November 15 and the filing window will open on November 1. This means your October report cannot be filed until November 1 or later and must be completed by November 15. Need help filing your report? Below is the final warning sent November 10. This is the fourth of four emails sent to those who hadn't filed their reports.

Failure to file will result in a filing surcharge fee as outlined below.  Please take five minutes right now, log in to your PRONETLicensing account and complete your Expense and Revenue Report for October.
  You can log in here. Once you log in, make sure you are in the My Client Area, look to right under Quick Links and choose Revenue/Expense & View Usage Stats. Enter your correct Gross Revenue and Expenses for October, Submit the report and you are done!

We are required by U.S. law to obtain accurate Gross Revenue numbers for our reports to the PRO's.  Per our T.O.S. if the Gross Revenue / Expense report is not submitted by the deadline, PRONETLicensing will charge the greater of a minimum of $5 or 20% of the licensed Revenue as a filing surcharge. You can avoid this surcharge by filing your report before the monthly deadline.

Terms Of Service

(Failure to read this information could result in increased fees.)
 
This is to notify you the PRONETLicensing T.O.S. (Terms Of Service) has been updated in several places. The major change that could affect you financially is quoted below:

    (Pre-existing in T.O.S.) You agree to file your previous month's Gross Revenue and Expense report using your StreamLicensing™ Online Reporting Form and you agree to file these reports within two weeks of the previous month's end date.
    (New update to T.O.S.) You agree that failure to file your previous month's Gross Revenue and Expense report by the filing deadline means PRONETLicensing may file your report for you based on the greater of: a) the previous month's reported numbers or b) the maximum expense and revenue which your plan allows. To keep fees down for those who do file their reports by the deadline, PRONETLicensing™ will charge you an additional processing fee which will be the greater of $5.00 or 20% of the resulting plan's Expense/Revenue license level.

This will be effective September 1. If you file your Revenue / Expense report by the filing deadline each month you will not pay a penny more than in the past. However, many Affiliates are not filing the required report on time. The law requires this monthly report. PRONETLicensing is required to file it monthly. Completing your report for you costs PRONETLicensing a significant amount of money. Rather than increase everyone's fees to compensate, I have decided to only charge those who fail to file.
